By planning for your family’s financial future, you also reduce the risk of making poor decisions when you are ill or incapacitated.
Following a loved one’s death, we help you probate the will through your county’s surrogate’s court so you can focus on dealing with the emotional aftermath.
Estate litigation
Contesting a will in New York State may require litigation in probate court. Challenging a will’s validity may be based on any of the following grounds:
- The loved one was not of sound mind when signing the will
- A beneficiary unduly influenced the will
- The loved one did not sign the will
- The will was not legally witnessed
We have longstanding experience as trial attorneys in New York and federal courts as well as in handling estate matters. To handle your estate litigation, we interview beneficiaries, relatives, and close friends to discern the deceased’s true intent for estate administration. If we need to prove the loved one’s mental state at the time of signing the will, we bring forward medical experts.
